A court decided that the federal ban on the sale of guns to medical marijuana card holders does not violate the Second Amendment. This decision involves states like Washington or California. It all began when a woman who had that card wanted to buy a self-defense gun in 2011. The gun store did not agree, as the law says that guns can’t be sold to illegal drug users. She decided to have this problem solved in a court.
The woman said she was not smoking marijuana, but wanted the card to support the legalization of this substance. However, the court decided that the law was right and marijuana card holders should not be able to buy guns. They thought they it can raise the risk of unpredictable behavior and guns should not be associated with it. The attorney of the woman claimed the Second Amendment, but he did not manage to convince the judges. He s aid that we live in a world where having a medical marijuana card is enough to say you are not able to get a gun. However, if you are not on the list, your right is still protected.
There are people who say that even marijuana is illegal in some states, those who smoke it can’t be dangerous because there is no effect that leads to violence. They say that those marijuana card holders who are responsible and prove they have no mental issue should have the same rights as other people. It seems that there will more arguments about this problem.
What is unusual is that even though marijuana is legal in many states, it still remains a substance accepted for medical use. The United States government protected the rights of gun owners for many years. However, these rights do not extend to people who are marijuana cardholders.
Marijuana is seen by many people like a safe drug. There was no death because of it and it can have benefits for our health. Even though some researchers proved that it can slow down cancer, people do not trust this drug. Its disadvantages can be discovered when a person is using often this drug. He/she could be less motivated and even have memory loss.
Do you think that the Second Amendment was violated? Marijuana card holders could be normal persons, with jobs and families and authorities should pay more attention to this law.
